Using
their new powers under the Regulatory Reform (HousingAssistance) (England
and Wales) Order 2002, Local Authorities (LAs), in some cases working
with Housing Authorities (HAs), are able to offer loans and equity
release packages.
Since October 2004, mortgages and loans have been regulated by the
FSA. The DCLG Guidance set out how LAs and HAs should deliver such
products, although they are exempt from full regulation. The guidance
requires LAs and HAs to explain clearly the consequences of taking
out a loan; what would happen in the case of default, and who would
deal with disputes. It also covers the need for staff to be adequately
trained.
The Guidance
The DCLG detail how customers should be treated from the "cradle
to the grave" i.e. from loan application to possession and how
procedures can be implemented efficiently. They
also provide standard forms and procedures to enable LAs and HAs
to implement the disclosure reforms speedily and effectively.
They
also cover complaints; how they should be treated and what recourse
customers have and from where.
